Criminal Liability for Violating Image Privacy through Information and Communications Technology under Yemeni and Comparative Legislation

Abstract

This study aims to analyze the criminal liability arising from the infringement of image privacy within the framework of Yemeni and comparative legislation, with a focus on the developments brought about by Information and Communications Technology (ICT). The researcher adopted a descriptive-analytical and comparative approach to examine legislative texts and relevant laws. The study concludes that the right to image privacy is a crucial element of the broader right to informational privacy. It further finds that, while legal protection exists in Yemeni legislation, it suffers from significant deficiencies in addressing contemporary challenges stemming from technological advancements. The study also reveals that most comparative jurisdictions have developed specialized legal frameworks to protect image privacy in the digital age, whereas Yemeni legislation continues to rely on traditional provisions. Consequently, the study recommends the development of Yemeni criminal legislation and the enactment of specific laws for the protection of informational privacy. These findings underscore the necessity of keeping pace with technological evolution to safeguard individual rights in the information age.
