Judge Abu Al-Taher Al-Dhuhli (279-367 AH / 892-977 AD): A study of his biography and role in the Fatimid state

Abstract

The study aims to shed light on the personality of Judge Abi al-Tahir Al-Thuhli (279-367 AH / 892-977 AD) and clarify his role in the Fatimid state as one of the important figures in Islamic history. The Arab Islamic state in general and the Fatimid state, in particular, played an important role in the judiciary institution, which is considered one of the supreme institutions in any state. The researcher followed the historical, analytical, and descriptive approach in preparing this study and reached a set of results, most notably: Al-Qadi Abu Al-Taher Al-Dhuhli is considered one of the Maliki jurists and trustworthy hadith scholars. He grew up in the homes of people of knowledge and destiny, and his father was one of the scholars, hadith scholars, and one of the chief sheiks of the Maliki judges in Iraq. The scholarly position that Judge Abu al-Taher al-Dhuhli enjoyed played a role in assuming the judiciary, and he was promoted in this position from a judge by the caliphate at the time of his father to an impartial witness until he became a judge in different regions of Iraq (Basra, Baghdad, Wasit) in the Abbasid era, and then he moved to Egypt and took over the judiciary of Damascus and Egypt during the era of the Ikhshidids and in the Fatimid state. His good policy, moderation, and ease of rulings played a role in his survival as a Malikite judge during the era of the Fatimid Ismaili school of thought.
