Comparison between the Meaning of the Text and the Zihar according to the Hanafis: Analytical Study

Abstract

The Hanafi school has its own characteristics and features, including their view of the significance of the text and zihar. Their importance in explaining the legal texts is clear. This study comes to reveal the significance of the text and zihar among the Hanafis. The starting point of this study was a set of questions that summarized the problem of this study, including: What is the concept of the significance of the text and zihar among the Hanafis? How can they be compared among them? The nature of the study relied on the induction and analysis methods. This study reached a set of results, the most prominent of which are: The text and zihar can be differentiated in terms of the ruling and indication thereof, and they agree with the Hanafis on some issues, and differ on most of them. The difference is that the text requires the market, unlike the zihar, and they agree that each of them is subject to specification, interpretation, and abrogation. The study recommends that attention should be paid to the issues of significance among the Hanafis, and that there should be a comparison between them among both the Hanafis and the majority, in order to arrive at the best uses that will help in establishing and deducing contemporary legal issues.
