Educational Legislation towards a Comprehensive Code: A Comparative Study between France and Morocco

Abstract

The article deals with the issue of the French legislator adopting an educational code that brings together the fragments of French educational legislation into a unified legislation, which makes it easier for researchers, scholars, and professionals alike to obtain educational information. Also, this legislative work goes beyond the inconsistency and contradiction of legal texts, and the large number of referrals made by law to Another law due to the passage of time on these legal texts.

The article opens the horizon for thinking about the feasibility of this experiment and the feasibility of adopting this comparative experience in Moroccan educational legislation, as the researcher has reached the conclusion that the matter will be useful, purposeful, beneficial, and profitable for the Moroccan educational system if it is adopted in the future.

The researcher also tried to look at some of the educational legislation in the two countries, focusing on the human element, which is not a real reform factor in light of its absence or marginalization of its role, as it is the backbone of every reform process, and this is what the Moroccan legislator tried to work on in the latest reform in the basic system for men and women in education.
