Abstract

This study addresses the guarantees of a fair trial in Qatari criminal law, aiming to examine the legal foundations that ensure citizens’ fundamental rights during criminal proceedings. The problem lies in how these guarantees are applied in the Qatari judicial system, despite the numerous legal provisions that protect these rights.

The study reviews the provisions of the Qatari Constitution and the Qatari Code of Criminal Procedure, highlighting the legal and procedural challenges that affect the effective implementation of these guarantees. The significance of the study lies in providing an analytical perspective on how justice is administered in Qatari courts, with a focus on the safeguards that ensure fair trials in both major and minor criminal cases.

The study aims to analyze Qatari legislation concerning the rights of defendants and examine the practices of the Qatari judiciary in ensuring equality and transparency during criminal trials. It relies on a descriptive-analytical methodology to study legal applications in Qatari courts and provide analyses of the challenges that may hinder the course of justice.

The findings indicate that the legislation provides effective guarantees; however, judicial delays and legal restrictions constitute the main obstacles. Judicial independence is a pivotal element in ensuring a fair trial, yet political influences in some cases may compromise the integrity of rulings.

The study also reaches several recommendations, including reviewing criminal legislation to reduce delays and enhancing judges’ training to ensure the application of criminal justice in accordance with international standards. Furthermore, it emphasizes the need to strengthen the role of the Public Prosecution in monitoring criminal cases to prevent external influences and to develop witness protection mechanisms to ensure the safe presentation of evidence in sensitive criminal trials.
