Legal Safeguards for Trademark Protection: A Comparative Study of Qatari Legislation and International Agreements

This study addressed the legal safeguards for the protection of trademarks through a comparative analysis between Qatari legislation and relevant international agreements, in light of contemporary economic and digital developments that have contributed to the increase and diversification of trademark infringements. The study revolves around a central problem concerning the adequacy and effectiveness of the legal safeguards established in Qatari law and their consistency with international standards. It adopted an analytical-comparative approach by examining the conceptual framework and legal scope of trademark protection, analyzing preventive and administrative safeguards related to trademark registration and management, and studying civil and criminal remedies, enforcement mechanisms, and procedures to address infringements, with particular focus on the challenges posed by the digital environment, especially e-commerce, domain names, and digital platforms. The study concluded that Qatari legislation provides an advanced legal framework aligned in essence with international standards, notably the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), yet the effectiveness of protection depends on proper implementation, efficient enforcement mechanisms, and judicial flexibility in assessing compensation and applying remedies. The study emphasizes that developing trademark protection does not necessarily require new legal provisions but rather strengthening implementation tools and adapting existing rules to the digital environment to ensure effective and balanced protection while enhancing confidence in the legal system.
